Did We Unwittingly Commit an Unforgivable Home Selling Blunder?

We just sold our home in April to a nice old couple—a $200k property that was mostly newly renovated within the last 4 years. We went above and beyond to make sure they were satisfied with the purchase. We installed custom handrails at their request, offered them to assume our loan (they were unfortunately unable to qualify after waiting 2 months), and even gave them $2k to help with closing costs.

Fast forward to this week, we were served a summons claiming that we intentionally put an area rug over vinyl flooring in a breezeway that was pulling up in some spots. We had that room decorated the same way for 3 years, and now the couple deemed it a latent defect and are seeking $3k to replace the 100sq ft breezeway with LVP. Both myself and the real estate firm that represented us are listed as defendants.

At first, this sounds like a baseless and super dumb claim. After all, the couple had a full inspection prior to buying the property, so this case seems to have no basis. But unfortunately, we’ll have to wait and see what the hearing brings. Hopefully the case will be put to the side and we can all move on from it.

This situation serves as a reminder to always be mindful of any potential latent defects when buying or selling a property. It’s important to get a thorough inspection and to discuss any concerns with the seller prior to purchase. It’s also wise to consider having a home warranty in place to protect against any unexpected issues that may arise.
