So, I’m in a bit of a bind and looking for some guidance here. My dad, who’s in his 80s, is the one holding the mortgage for our family home. The tricky part is that my brother X, who’s in his 40s and lives with my dad and our other brother, has a pretty troubling history. He’s a narcissistic sociopath, to put it plainly, with a criminal record that includes assault against our own family members. Currently, X is living in his car due to being on probation, which prohibits him from residing in the house. He’s unemployed, bitter, and dead-set on getting his hands on the property when our dad passes away.

Now, my dad added X to the property deed years ago under pressure because X wouldn’t let up about it. But now, the situation is a mess. My dad, my other brother, and I all agree that having X inherit the house is a disaster waiting to happen. X’s track record of violence, harassment, and general chaos is a major cause for concern. There’s no restraining order in place, just the terms of his probation, but that doesn’t make the situation any less volatile.

With my dad surviving on just his Social Security income, the idea of buying X out seems unfeasible. Plus, we have serious doubts that X would even agree to such a deal. The prospect of selling the house or relocating is also complicated, given my dad’s age and health issues. So, what are our options here? I’ve heard about the concept of partition and the possibility of buying X’s share, but is there anything else we can explore?

One thing is certain: nobody feels safe around X. And the fact that he plans to kick my other brother out of the house once our dad is no longer around only adds to the tension. As the eldest child and next of kin, I’m wondering if I have any legal leverage over X in this situation. It’s a tough spot to be in, and it’s taking a toll on my dad, who’s caught in the middle of all this conflict and stress.

If anyone has any insights, advice, or suggestions on how to navigate this messy family dilemma, I’m all ears. It’s a tough situation, and I’m just trying to figure out the best way forward for everyone involved.
